Mithril Privacy Policy

This privacy policy describes how Foundry Technologies, Inc. and its affiliates (“Mithril,” “we,” “our,” or “us”) processes information about individuals, including those who use our websites and online services (collectively, our “Services”). This privacy policy does not apply to the information processed by us on behalf of our customers through our platform, which is governed by our customer agreement.

INFORMATION WE COLLECT

We may collect a variety of personal information from or about you from various sources, as described below.

  1. Information You Provide to Us

We collect information you provide directly to us. For example, we collect information directly from you when you make a purchase, create an account, fill out a form, participate in a promotion, request support, apply to work for us or otherwise communicate with us. The types of information that we collect directly from you include your name, contact information (such as email and phone), company name, and any other information you choose to provide. Additionally, if you make a purchase through our Services, we work with a third-party payment processor to process your payment information.  And, if you apply for a position with us, we may collect additional information in connection with your application, such as your LinkedIn profile and professional website, your social security number, eligibility information, demographic information (e.g., age, gender, marital status, race or ethnicity, veteran status and disability status), education information (such as names and graduation dates of schools attended) and application materials (e.g., resume, cover letter, employment history and current salary). 

B. Information We Collect When You Use Our Services

Device Information. We may receive information about the device you use to access our Services, such as IP address, operating system version, phone carrier and manufacturer, device identifiers, mobile advertising identifiers, and push notification tokens.

  • Usage Information. We automatically receive information about your interactions with our Services, like the pages or other content you view and the dates and times of your use.

  • Information from Cookies and Similar Technologies. We and our third-party partners may collect information through our Services and emails using cookies, pixel tags, or similar technologies. These technologies may collect information about your online activities on our Services and over time and across different websites and online services, including including your device identifiers, IP address, web browser and mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, order information, and conversion information. 

  • Audio and Video Recordings.  We may capture photographs and video recordings in our locations through our security cameras. If you contact customer service, we may also monitor, record and retain those conversations.

C. Information We Receive from Third Parties

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address or infer that you may be interested in certain products or Services based on your use of the Services and past purchases.

D. Payment Processing

We may receive additional personal information about you from other sources, such as marketing partners or providers, public and other databases, social media platforms such as LinkedIn, Facebook, Twitter, or Google, or from conference or event hosts. For example, if you apply to work for us, we may receive information from your previous employers or schools you attended, your references or referrals, recruiting agencies, recruitment services providers, publicly accessible sources such as your LinkedIn profile and other social media platforms and through background checks (if applicable).

HOW WE USE THE INFORMATION WE COLLECT

We use the personal information we collect:

  • To provide, maintain and improve our Services and develop new products and services;

  • To tailor the content and information that we send or display to you, offer personalized recommendations, and otherwise personalize your experience while using our Services;

  • For marketing and promotional purposes, including to send you marketing communications and to target advertising to you on third-party platforms;

  • To manage our relationship with you, including to provide customer support and to send you technical notices, security alerts, support messages, and other transactional or relationship messages;

  • To evaluate job applications and consider you for other positions with our company;

  • To monitor and analyze trends, usage and activities in connection with our Services; 

  • To detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of Mithril and others;

  • To comply with our legal obligations; and 

  • For other purposes for which we provide specific notice at the time the information is collected.

We may also aggregate and/or de-identify information collected through our Services. We may use deidentified or aggregated data that is no longer deemed personal information under applicable law for any purpose, including for research and marketing purposes and may also disclose such data to other parties, such as advertisers, promotional partners, sponsors, event promoters, and others.

HOW WE DISCLOSE THE INFORMATION WE COLLECT

We disclose information we collect about you as follows:

  • Affiliates or Subsidiaries. We may disclose information with our affiliates or subsidiaries for any of the purposes described in this privacy policy.

  • Vendors and Service Providers.  We make personal information available to our vendors, service providers, contractors and consultants who perform services for us, such as companies that assist us with web hosting, marketing and advertising, payment processing, recruitment, fraud prevention, customer service, IT support, and analytics.

  • Compute Providers.  If you purchase compute resources from a third-party compute provider, we may disclose relevant information about you, your company and the proposed compute project to complete the transaction.  

  • As Required by Law and Similar Disclosures. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

  • To Protect the Rights of Us and Others. We may disclose personal information if we believe that your actions are inconsistent with our agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Mithril, our users, the public, or others.

  • Merger, Sale, or Other Asset Transfers. We may disclose and transfer your personal information in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company, or we sell, liquidate, or transfer all or a portion of our business or assets.


Consent. We may also disclose personal information from or about you with your consent.

YOUR RIGHTS AND CHOICES

Account Information. You can access or correct certain information stored within your online account at any time by logging into your online account.

  • Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out of receiving promotional messages from us, you will continue to receive non-promotional messages from us.

  • Interest-Based Ads.  You can learn more about interest-based ads, or opt out of having your web browsing information used for behavioral advertising purposes by companies that participate in the Digital Advertising Alliance, by visiting www.aboutads.info/choices. For individuals in the EEA, please visit www.youronlinechoices.eu and for individuals in Canada, please visit https://youradchoices.ca. Your device may also include a feature that allows you to opt out of having certain information collected through mobile apps used for behavioral advertising purposes.

  • Cookies. You can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect some of the functionality of our Services.

Note that there is currently no accepted standard on how to respond to Do Not Track signals, and we do not respond to such signals.

INTERNATIONAL USERS AND VISITORS

We are based in the United States and process and store personal information on servers located in the U.S. We use third party service providers that may be located in, or have servers in, another country.  Where required by law, we provide adequate protection for the transfer of personal information in accordance with applicable law, such as by obtaining your consent, relying on the European Commission’s adequacy decisions, executing Standard Contractual Clauses, or complying with another approved data transfer mechanism. CHANGES TO THIS PRIVACY POLICY

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through our Services, we will attempt to notify you through our Services, by email, or other means.
